Muertos griegos, seres sintientes. El uso de las emociones de los muertos como una herramienta jurídica en Atenas clásica

El enojo es una herramienta valiosa para el funcionamiento de las relaciones morales y políticas. Por otro lado, es considerado como una amenaza a los vínculos sociales por su naturaleza vindicativa. Sin embargo, en ciertos contextos, las sensaciones bruscas como el enojo y su contracara, el miedo a las represalias de quien se enoja, pueden ser identificadas como emociones reactivas que incentivan a los jueces a fallar de tal o cual forma. Los eventos que requieren que la justicia repare a la persona dañada evocan respuestas emocionales en las víctimas, en los jueces y en el público en general. ¿Pero qué ocurre cuando la emoción es experimentada por un muerto?
En el presente trabajo nos proponemos analizar unos pasajes que ilustran cómo los oradores utilizaron el conocimiento popular sobre el enojo vengativo de los muertos para estimular el miedo en los jurados y, así, impulsarlos a condenar. Asimismo, veremos cómo esta herramienta retórica importó la creación de una audiencia ficcional que, velando por la defensa de los valores tradicionales, llenara la brecha institucional propia del sistema jurídico clásico, que no contaba con un ente jerárquico que regulara el contenido del juicio o el voto de los jueces.
